1. Basic data and term definitions

1.1 Seller

DV hockey a.s., Sports Hall, 29.dubna 259/33, 700 30 Ostrava-Vyskovice, Czech Republic. Ident. No.: 60778857.

This company is recorded in the Business Registry administered by a Regional Court in Ostrava, Section B, insert 4411.

Further only "Seller".

1.2 Goods

The Goods are any products offered on pages DV-Hockey.com.

Further only "Goods".

1.3 Buyer

The Buyer is an entity (physical or legal), which closed an Agreement to buy the Goods with the Seller.

2. Ordering of the Goods

2.1 Execution of an order

All prices for the Goods on pages DV-Hockey.com are valid at a time of order placement. A price on the order is final and is shown inclusive of all charges (shipping, postal). By placing an order the Seller agrees with a given price.

Since all the Goods is custom made, the Seller does not guarantee that the Goods is available at the time of order, not even in case, when the Seller orders the Goods in standard parameter combinations.

A placed order (properly filled through shopping basket, possibly including contact information) is an offer to close a buying agreement. By order confirmation is this Agreement between the Buyer and the Seller closed.

2.2 Order cancellation

Before the Buyer is notified by the Seller of order acceptance, both sides can withdraw from the order without specifying a reason.

Withdrawing from a buyer agreement between the Buyer and the Seller is possible only by mutual agreement under mutually agreed conditions.

3. Sending of the Goods

This article (3) concerns the Goods that is sent to the Buyer through third parties (post, delivery service).

A necessary condition for sending the Goods to the Buyer is a properly closed buying agreement, see 2.1 Execution of an order

3.1 Delivery

Maximum time for an order execution (manufacture of the Goods and handling) is 15 days after order acceptance. Time needed to deliver the Goods from the Seller to the Buyer does not count into this period. If this period of 15 days is exceeded, the Buyer must be immediately informed, and has a right to withdraw from an agreement or other compensation (for example discount), but only in case that between him (the Buyer) and the Seller were not agreed individual conditions of the buyer agreement.

By delivery of the Goods to the address specified in an order is the Goods considered delivered.

3.2 Transport

Transport of the Goods is done by the Seller. The transport of the Goods is possible only within the Czech Republic. Possible transport abroad is a subject of an individual agreement with the Buyer.

The Goods are sent within the Czech Republic as a business package by Czech Post s.p., its delivery is guaranteed within two days from submission of the shipment. It is possible to follow the shipment, in case that an addressee is not reached, the shipment is deposited at the nearest post office, for more see information about Business package service at Czech Post s.p. web pages..

Postal charges in CR are 180.00 CZK (incl. VAT), in case of an order above 5 000.00 CZK (incl. VAT) postage is not charged. Postal charges are a part of an order total price.

3.3 Payment

A payment for the Goods is made as Cash on delivery at a place of delivery or at a post office when picking up the deposited shipment. It is also possible to pay up front by money transfer to our account.

3.4 The Goods acceptance

A shipment with the Goods always contains the ordered Goods, tax receipt, and user manual for the Goods.

The Buyer is obliged to check the Goods at the time of acceptance. The Buyer confirms by his signature at the time of the acceptance that the Goods was in an intact packaging and in good order.

If the Buyer finds at the acceptance of the Goods that the Goods or its packaging is damaged, he will write a protocol about a damaged shipment with a delivery person or an employee of the Czech Post s.p., which needs to be confirmed by the delivery personnel. Based on this protocol the Buyer obtains a right to withdraw form a buying agreement or a claim to an adequate compensation (discount), or claim to the flawless Goods.

Claims based on goods damaged at shipping made after the Goods acceptance will not be honored.

4. Personal pick-up of goods

Location of a personal pick-up is shop of the Seller.

At a time, when the Goods are ready for pick-up by the Buyer, is the Buyer informed about it by the Seller. A goods pick-up period is 14 calendar days.

The Buyer has a right to see the Goods before he closes a buying agreement with the Seller.

The buying agreement is fulfilled by a payment of the full buying price, which was confirmed to the Buyer on an order, and by acceptance of the Goods by the Buyer.

5. Guarantee conditions

Guarantee conditions are governed by the Law No. 40/1964 Coll. (Civil Law), as amended.

A standard guarantee period is 24 months for all assortment on  DV-Hockey.com, unless specified otherwise. For custom made goods this guarantee period lasts for 6 months.

The guarantee period starts to run at a time of the Goods acceptance by the Buyer.

Guarantee sheets are not specially made. A tax receipt serves as a guarantee document.

The guarantee covers manufacturing faults and possible shipping from the Seller to the Buyer damage. The guarantee does not cover normal wear and tear and improper use of the Goods (especially if it is in disagreement with a user manual) or using of the Goods to other purpose than it is intended to (nature of the Goods).

The Buyer (private person, not business or legal entity) has in cases specified by Law No. 40/1964 Coll. right to withdraw from a buying agreement. Withdrawing from the buying agreement is effective by its delivery to the Seller. A withdrawal from the buying agreement must be made in writing. In case of a withdrawal are both agreement parties obliged to return (or replace) all accepted items. At the time of the agreement withdrawal is the Buyer required to return the undamaged Goods (in case that he accepted it previously), original tax receipt, and order identification. The Goods must be returned in undamaged packaging and perfect condition, otherwise an adequate part of a purchase price shall be subtracted.

6. Claim rules

If a problem, which is covered by a guarantee, occurs with the Goods within a guarantee period, the Buyer has a right to make a claim.

According to the Law No. 634/1992 Coll., is the period to settle the claim 30 days, unless the Buyer and the Seller agree differently.

The Goods that the Buyer sends to the Seller for settlement or evaluation of a claim, must be ensured in such way, as to avoid its damaging.

The Buyer can inform himself on a status of the claim. This information shall be divulged only to the Buyer. The Buyer can ask at specified contacts.

7. Other provisions

These Business conditions govern relationship between the Seller and the Buyer or Customer.

These business conditions are in effect from 1.1.2007

We have a right to change the Business conditions. The changes will be published on pages  DV-Hockey.com at least seven days before they come into effect.
